Terms of Service

Last updated: September 19, 2026. These Terms govern your use of the OurBeach marketing website at ourbeach.art and related public pages. They are plain-language site terms, not a substitute for legal advice, and may be updated from time to time.

Agreement

By using ourbeach.art, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.

Paid installations

Purchasing, installing, or operating OurBeach hardware and software is governed by the Service Agreement you review and electronically sign after Stripe Checkout on app.ourbeach.art/sales/—not by these website Terms alone. That agreement covers subscription fees, deposits, hardware, billing, trial windows, cancellation, and related commercial terms.

To cancel a paid subscription under the Service Agreement, send written notice to support@ourbeach.art or alex@azolla.studio (30-day notice outside the trial window, as stated in your signed agreement).

Website content

Marketing pages describe OurBeach for informational purposes. Features, pricing, availability, and timelines may change. Nothing on the marketing site is a warranty, guarantee, or offer unless confirmed in a signed Service Agreement or other written agreement with Azolla Studio LLC.

Intellectual property

OurBeach branding, site design, text, imagery, and software are owned by Azolla Studio LLC or its licensors. You may not copy, scrape, reverse engineer, or redistribute site materials or OurBeach visual output except as expressly allowed in a signed agreement.

Acceptable use

Do not misuse the site or related APIs: no unauthorized access, scraping that impairs the service, spam, malware, or attempts to disrupt operations. Installation request forms are for genuine inquiries only.

Third-party services

Checkout and payments are handled by Stripe. Your use of Stripe is also subject to Stripe’s terms and privacy policy. Links to third-party sites are provided for convenience; we are not responsible for their content or practices.

Disclaimers

The marketing site is provided “as is.” To the fullest extent permitted by law, Azolla Studio LLC disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement regarding the site and its content. OurBeach displays are artistic, data-driven environments—not safety-critical meteorological or navigation instruments.

Limitation of liability

To the fullest extent permitted by law, Azolla Studio LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the marketing site. Liability related to a paid installation is governed by your Service Agreement.
